Our process may look something like this...

Gather Evidence

We’ll take care of gathering evidence, such as the accident report, your medical records and bills, and any wage loss documentation.  We will also speak to any witnesses to the accident itself and get opinions from your medical providers that may be relevant to your case.

Send A Demand Letter

Once we’ve gathered all the requisite paperwork and your medical treatment is finished, we’ll send a demand letter to notify the other party we are seeking damages and begin the process of settlement negotiation.

Settlement​

After receiving an offer from the insurance company, your attorney will call you to discuss the offer and give their opinion as to what a fair settlement value for your claim would be. Your attorney will then negotiate with the adjuster based on that decision.  If the parties can agree on a final number, the case will be “settled” at this time.  This means that you agree to drop the case as long as the defendant pays the agreed amount of compensation.

Breaking Down a Personal Injury Claim.

Negligence describes a situation in which a person acts in a careless (or “negligent”) manner, which results in someone else getting hurt or property being damaged.  Pursuing a claim of negligent actions is one of the most common routes for plaintiffs in a personal injury case.

Liability is the concept of fault, more so the idea of which party involved in any type of accident bears the responsibility for its occurrence. When someone is held liable for an accident or injury, they are deemed as the fault party, or simply the party responsible for the accident or injury.

In order for a personal injury claim to exist, the at-fault party’s negligent behavior must have caused you some kind of injury.  There are a wide variety of injuries covered in personal injury law.  Some of the common types include:

  • Soft tissue injuries.  These types of injuries often occur in car accidents and include sprains, strains, and contusions.  Low back pain and whiplash are common examples of soft tissue injuries.
  • Objective injuries.  These types of injuries include anything that can be definitively diagnosed by a medical scan, such as broken or fractured bones, a rotator cuff tear, or a slipped disc.  Broken bones are more common in slip and fall cases, but can occur in any type of case.
  • Brain injury or concussion.  There are varying degrees of head injuries that can occur as a result of personal injury.  Symptoms of a mild concussion may resolve soon after an accident with no lasting consequences, while a traumatic brain injury can have lasting effects on the way your brain functions.
  • Permanent injuries.  Any serious injury has the potential to leave you with permanent impairment.  Injuries that require surgery sometimes never return to pre-accident condition.  Scarring is another example of a permanent injury and is common in dog bite cases as a result of lacerations to the skin.  Only a medical professional can advise whether or not your injuries are likely to be permanent. 

Just because you have a claimed injury does not necessarily mean you are entitled to recover from the at-fault party.  You must have identifiable damages, which generally come in the form of medical bills and lost wages.  Of course, you are also permitted to claim pain and suffering as a form of damages, but rarely will these kinds of damages alone support a personal injury claim.  If you are never treated for your injuries, it will be very difficult to sustain a personal injury claim.
